Last Will and Testament
Nancy Drewry Holt (1790 - 1861)
Daughter of Major Humphrey Drewry
Southampton County, Va.

In the name of God, Amen. I, Nancy Holt, of the County of Southampton and State of Virginia, do make and publish this to be my last will and testament in manner and form as follows, hereby expressly revoking all wills and testaments heretofore made by me, to wit:

Item 1st: I give to my three nieces, Nancy D. Macklin, Frances J. Lundy, and Mary E. Short, one thousand dollars each and this provision, if either the above named parties die without issue to attain the age of twenty one years or marry, it is my will that the surviving sisters or sister or their descendants shall heir the portion of such deceased party each descendants taking the share which their deceased parent would take if living provided such descendants live to attain the age of twenty one years or marry.

Item 2nd: I give to my two nieces, Nancy J. Drewry and F.A.V. Mason, one thousand dollars each under this provision if they leave any descendants to arrive to the age of twenty one years or marry otherwise if they or either of them should leave no such descendants such legacy or legacies I direct to be returned to my estate for the benefit of my residuary legatees.

Item 3rd: I give to my niece, Martha F. Drewry, one thousand dollars provided she leaves any descendants who may attain the age of twenty one years or marry otherwise I give the said legacy to her surviving brothers or brother or their descendants if such descendants or descendant attain the age of twenty one years or marry such descendants taking the share which their deceased parent would take if living, if no such descendants then the said legacy is to revert back to my estate for the benefit of my residuary legatees.

Item 4th: The specific legacies given in the first, second and third clauses of my will I expect to be raised and paid out of money due my estate, but should it be ascertained after settlement of my estate and legal claims that my said named estate is insufficient to pay said legacies in full it is my desire under such circumstances that the said legacies be sealed among this and legatees taking the same proportion from each of said legacies. It is not my will or intention that my servants be sold to pay such legacies or for any other purpose but to be provided for as I shall hereafter direct.

Item 5th: It is my will and desire that all my slaves be divided into three equal parts, one third of the same I give to my brother Samuel Drewry, one third to my brother James Drewry, provided they live to receive them, but should either or both die before getting possession of them, then I give the slaves intended for them to such of their children as may attain the age of twenty one years or marry, such descendants taking equally the share of their respective parents. The remaining third part of my slaves I give to my two nephews William H. and James H. Drewry equally divided between them, on this condition that should either of them die leaving no issue I give his portion to the survivor; and should both die leaving no child or children to arrive at the age of twenty one years or marry, I give their portion and all their increase to my brothers Samuel and James Drewry in same manner or with the same directions and provisions as applied to the other property herein given them.

Item 6th: I give to my two brothers Samuel and James Drewry to be equally divided between them two thirds of the balance of my estate of every kind with the same provisions and in the same manner as applied to the other property herein before given them. The remaining third of said balance I give to my two nephews William H. and James H. Drewry with the same provisions and with the same manner as their portion of my slaves herein before is given to them, that is, if they both die without child or children to arrive at the age of twenty one years or marry, the same with all profit arising from it, is to go to my brothers Samuel and James Drewry in the same manner and with the same provision as applied to the gift of their portion of my slaves.

Item 7th: I constitute and appoint my brothers Samuel and James Drewry my whole and sole executors to this my last will and testament and hereby request the court to which this will may be presented for probate not to require said executors above named to give security on obtaining administration in my estate. In testimony whereof, I have hereunto set my hand and seal this 22 day of February, 1860.
